These Terms of Service (“Terms”) govern your use of the website at apturestudio.com (the “Site”) and any inquiries, communications, or services provided by Apture LLC(“Apture Studio,” “we,” “our,” or “us”). By accessing the Site or contacting us, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

Apture LLC is a multimedia creative studio offering services across applications and software, film and motion, sound and score, and brand and design. The full description of our offerings is on our Services page.

2. Use of the Site

You agree to use the Site only for lawful purposes. You will not:

• interfere with the operation, security, or integrity of the Site;
• attempt to access areas of the Site you are not authorized to access;
• use the Site to transmit malware, conduct scraping at a scale that burdens the Site, or harass any person; or
• violate any applicable law or the rights of any third party.

3. Inquiries are not contracts

Sending us an inquiry or receiving a reply from us does not create a contract for services. Apture Studiois engaged only when both parties sign a written proposal, statement of work, or other agreement (an “Engagement Agreement”). The Engagement Agreement governs the scope, fee, timeline, and other project-specific terms, and prevails over these Terms in case of conflict.

4. Intellectual property

All content on the Site, including text, layout, graphics, logos, code, photography, and video, is owned by Apture LLC or its licensors and is protected by copyright, trademark, and other laws. You may view the Site and share links to public pages. Beyond that, you may not copy, reproduce, modify, distribute, or create derivative works from the Site without our prior written permission.

Ownership of work product created during a paid engagement is addressed in the applicable Engagement Agreement.

5. Third-party links

The Site may link to third-party sites or resources. We don’t control those sites and aren’t responsible for their content or practices. Following an external link is at your own risk.

6. Disclaimers

The Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.

7. Limitation of liability

To the maximum extent permitted by law, Apture LLC and its members, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability arising from your use of the Site is limited to one hundred United States dollars (US $100). Liability under a specific Engagement Agreement is governed by that agreement.

8. Indemnification

You agree to indemnify and hold harmless Apture LLCand its members, employees, and contractors from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Governing law and disputes

These Terms are governed by the laws of the United States and the state in which Apture LLC is registered, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to the personal jurisdiction of those courts.

11. Changes

We may update these Terms from time to time. The current version will always be posted on this page with the effective date above. Continuing to use the Site after a change becomes effective constitutes acceptance of the updated Terms.
